Acceptance of Terms

These Terms & Conditions govern your use of the Engines Factory website and any quote, order, or purchase made through it. Engines Factory is an online brand and website operated by HYML Powertrain LLC, a Delaware limited liability company based in Wilmington, Delaware. By using this website, requesting a quote, submitting an order, or completing a purchase, you acknowledge that you have read, understood, and agreed to these Terms & Conditions and the policies referenced on this page. If you do not agree with these terms, do not use the website or place an order.

Installer & Buyer Responsibility

All engines, transmissions, cylinder heads, and other powertrain products must be installed by an established professional automotive repair facility with verifiable business information and the tools, equipment, training, and experience appropriate for the application. Where required by the applicable warranty program, supplying manufacturer, or law, the repair facility must hold any required license or certification. ASE certification is strongly recommended and may be required to qualify for labor reimbursement under the applicable written warranty.

Before installation, the buyer and installer must verify the vehicle identification number (VIN), year, make, model, engine size, engine code, casting number, serial number, and all other application information. The installer must compare the replacement product with the original unit, inspect it for visible damage or discrepancies, and confirm that it is correct and suitable for the intended application. Any damage, discrepancy, or fitment concern must be reported to Engines Factory before installation.

The installer must follow all supplied installation instructions and accepted professional installation procedures. The installer is also responsible for identifying and correcting any vehicle condition that caused or contributed to the original failure, including, where applicable, problems involving the cooling, lubrication, fuel, air-intake, exhaust, electrical, emissions, transmission-cooling, or contamination systems. Required fluids, filters, seals, gaskets, coolers, lines, sensors, and related components must be serviced or replaced when specified.

The buyer must retain a detailed paid installation invoice that identifies the repair facility, vehicle VIN, mileage, installation date, product installed, labor performed, and related parts and fluids. Proof of professional installation and maintenance may be required for warranty registration, technical assistance, claim evaluation, or labor reimbursement. DIY, residential, or undocumented installations are not eligible for labor reimbursement.

Warranty coverage will not be denied solely because an independent or non-ASE repair facility performed the installation. However, to the extent permitted by law, coverage may be denied for damage or failure caused by improper installation, incorrect application, failure to follow instructions, overheating, inadequate lubrication, contamination, misuse, neglect, unauthorized tuning or modifications, or failure to correct a related vehicle condition. All warranty coverage and labor reimbursement remain subject to the separate written warranty applicable to the purchased product.

Order Acceptance & Payment

An order is not final or accepted until full payment has cleared and Engines Factory has confirmed the order and application information. A quote, invoice, checkout submission, or payment authorization does not by itself constitute final acceptance. Engines Factory reserves the right to decline or cancel an order because of product unavailability, an incorrect price or listing, suspected fraud, incomplete information, or inability to verify the application or fitment. If Engines Factory cancels an order after receiving cleared payment, the amount paid for the canceled order will be refunded to the original payment method.

Quotes, Pricing & Availability

Quotes are based on the information provided by the customer and are valid only for the period stated on the written quote. Prices, freight charges, taxes, fees, product availability, and estimated lead times may change before full payment has cleared and the order has been accepted. Website listings and availability statements do not guarantee immediate shipment. Special-build, custom, or supplier-dependent products remain subject to factory confirmation. Engines Factory reserves the right to correct pricing, description, availability, or typographical errors and to decline or cancel an affected order. If a material change occurs after payment has cleared but before shipment, the customer will be notified and offered the available options, which may include accepting the revised terms, selecting an alternative product, accepting a revised estimated ship date, or receiving a refund for the affected unshipped item.

Cancellations & Order Changes

Once payment is confirmed, the order enters processing immediately. Any customer-requested cancellation before shipment is subject to a 15% cancellation fee, with a minimum cancellation charge of $250, whichever is greater. A cancellation request is not effective unless it is received and approved in writing by Engines Factory.

No cancellation fee will apply if Engines Factory cannot fulfill the order, cancels the order, or confirms that the cancellation is required because of a billing or order-entry error made by Engines Factory. In those situations, the customer will receive a full refund.

Once an order has shipped, it can no longer be canceled. Any approved post-shipment return will be handled under the Return & Refund Policy and is subject to the applicable 25% restocking fee, original outbound freight cost, return freight, and any applicable carrier, handling, residential, liftgate, redelivery, storage, or other accessorial charges. All returns require prior written authorization, must satisfy the applicable eligibility requirements, and remain subject to inspection before any refund is approved. Unauthorized returns may be refused.

Special-build, custom-built, modified, application-specific, or specifically sourced products are non-cancelable and non-refundable once production, machining, assembly, customization, procurement, or other order-specific work has begun. If cancellation is approved before such work begins, the standard cancellation fee stated above applies. These restrictions do not limit any rights required by applicable law.

Shipment Inspection & Freight Damage

Engines Factory takes reasonable precautions to prepare and protect every shipment. However, the customer, consignee, or receiving facility is responsible for inspecting the shipment carefully before signing the Proof of Delivery or delivery receipt. If the order is delivered to a repair shop, warehouse, or other third party, the customer must make sure that the person receiving the shipment follows these inspection requirements.

Before signing, inspect the pallet, crate, packaging, and all visible areas of the product. Pull back the plastic or protective covering as necessary to check for dents, cracks, broken components, missing items, shifted freight, or other signs of damage. Confirm that the number of pieces received matches the delivery documents.

If damage or a shortage is visible or suspected:

• Write a clear and specific description of the damage or shortage on the Proof of Delivery or delivery receipt before signing. Do not write only “subject to inspection.”
• Take photographs of the entire shipment, the damaged areas, the packaging, shipping labels, pallet, and delivery documents.
• Refuse the shipment when the damage is severe or the product cannot be safely accepted.
• When accepting damaged freight, make sure all damage is clearly documented on the delivery receipt and obtain a copy.
• Contact Engines Factory on the same business day at sales@enginesfactory.com or by telephone.
• Keep the product, pallet, crate, plastic, and all packaging materials available for inspection. Do not install, disassemble, repair, or alter the product until Engines Factory provides instructions.

If concealed damage is discovered after delivery, stop unpacking or installation immediately, preserve all packaging and delivery documents, take detailed photographs, and contact Engines Factory as soon as possible.

Signing the delivery receipt without noting visible damage or shortages may be treated as confirmation that the shipment was received in apparent good condition and may limit Engines Factory’s ability to assist with or recover a freight claim. Freight claims remain subject to the carrier’s investigation, documentation requirements, deadlines, and final decision. Engines Factory cannot guarantee approval of a carrier claim when the required inspection and documentation procedures were not followed.

Core Deposits & Core Returns

Core deposits, return deadlines, freight charges, inspection requirements, core eligibility, and refund conditions are governed by the Core Return Policy applicable to the purchased product. Core-return freight is not included with standard outbound shipping and may be deducted from the refundable core deposit. Customers must obtain return authorization and follow all provided return instructions before shipping a core. Please review our Core Returns page for complete requirements.

Returns & Refunds

Returns, refund eligibility, authorization requirements, restocking fees, freight charges, inspection procedures, and nonreturnable products are governed by our Return & Refund Policy. Customers must obtain prior authorization before returning any product.

Warranty Coverage

Warranty coverage is product-specific and is governed by the written terms applicable to the product purchased. Gas engines, diesel engines, marine engines, transmissions, cylinder heads, and other powertrain products may have different warranty periods, parts-and-labor coverage, eligibility requirements, exclusions, claim procedures, and reimbursement limits. The applicable warranty coverage will be identified on the customer’s quote, invoice, order documentation, or our Warranty Information page. No warranty term applies unless it is stated in writing for the purchased product. Customers are responsible for complying with all applicable installation, maintenance, documentation, and claim requirements.

Limitation of Liability

Except for remedies expressly provided under the applicable written warranty, and to the fullest extent permitted by law, Engines Factory will not be liable for indirect, incidental, special, punitive, or consequential losses arising from a product, order, shipping delay, installation, or use, including loss of use, vehicle downtime, towing, storage, rental expenses, lost profits, or business interruption. Engines Factory’s total liability for any claim relating to a product or order will not exceed the amount actually paid for the affected product. These limitations do not apply to rights or liabilities that cannot legally be limited.

Website Use & Intellectual Property

All website content, including text, photographs, graphics, logos, product descriptions, designs, and other materials, is owned by or licensed to Engines Factory and is protected by applicable intellectual-property laws. Content may be viewed and used only for personal, lawful, and noncommercial purposes. No content may be copied, reproduced, modified, republished, distributed, scraped, resold, or used to create competing materials without prior written permission. Users may not interfere with website operation, attempt unauthorized access, submit false information, or use the website for fraudulent or unlawful purposes

Your use of this website is also subject to our Privacy Policy. Engines Factory may use the contact information you provide to communicate with you about quotes, payments, orders, shipping, delivery, warranties, and customer-service matters.
